Emergency powers

64Compensation for property requisitioned or destroyed

  1. Reasonable compensation is payable for any loss or destruction of property if the Water Services Authority, or any person acting at the Water Services Authority’s direction under section 62,—

  2. requisitions any property from any person for use in a drinking water emergency; or
    1. destroys any property in order to prevent, reduce, or eliminate the serious risk to public health.
      1. Reasonable compensation under subsection (1) is payable, on written application by any person having an interest in the property, by the Water Services Authority out of money appropriated by Parliament for the purpose.

      2. Compensation is not payable under this section to any person who caused or contributed substantially to the duty that brought about the requisition or destruction.

      3. The Water Services Authority may require a drinking water supplier who has caused or contributed substantially to an emergency to reimburse the Water Services Authority for all or part of any compensation paid by the Water Services Authority under this section in relation to that emergency.

      4. A person may appeal to the District Court in accordance with section 93(2) and (3) against—

      5. the Water Services Authority’s decision to pay or refuse to pay compensation under this section; or
        1. the amount of compensation determined to be payable under this section; or
          1. the determination of liability of any person to reimburse the Water Services Authorityi under subsection (4).
