The Water Services Authority must review a decision you think is wrong. They will make a new decision as soon as they can, within 20 working days. You cannot have the same person who made the original decision review it. The Water Services Authority can decide to keep the original decision, change it, or get rid of it. They can also get rid of the original decision and make a new one. If they need more information from you, they will ask and you must give it to them within a certain time. If you do not give them the information they need, they can make a decision without it. If they do not make a new decision within 20 working days, the original decision stays the same.

90Decision of Water Services Authority

  1. The Water Services Authority must review the reviewable decision and make a decision—

  2. as soon as practicable; and
    1. in any case, within 20 working days after the application for internal review is received.

      1. However, the individual who made the reviewable decision must not review the decision.

      2. The Water Services Authority’s decision may—

      3. confirm or vary the reviewable decision; or
        1. set aside the reviewable decision; or
          1. set aside the reviewable decision and substitute another decision that the Water Services Authority considers appropriate.

            1. The Water Services Authority may seek further information from the applicant, and, if it does,—

            2. the applicant must provide the information within the period (not less than 7 working days) specified by the Water Services Authority in the request for information; and
              1. the period specified in subsection (1)(b) ceases to run until the applicant provides the information to the Water Services Authority.

                1. If the applicant does not provide the further information within the required time, the Water Services Authority may make a decision on the internal review on the basis of the information held by the Water Services Authority.

                2. If the reviewable decision is not varied or set aside within the period specified in subsection (1)(b), the decision is to be treated as having been confirmed by the Water Services Authority.
