You commit an offence if you intentionally make or put together a firearm or restricted weapon using parts that were made, brought into the country, or sold illegally. You also commit an offence if you agree to make or put together a firearm or restricted weapon using illegally obtained parts. If you do not have a dealer's licence, you commit an offence if you make firearms, pistols, or restricted weapons to sell or supply to others. You commit an offence if you do not have a dealer's licence and agree to make firearms, pistols, or restricted weapons to sell or supply to others. You must mark any firearms or parts you make according to the law and regulations made under section 74. If you break these rules, you can be sent to prison for up to 10 years. Any agreement to make or supply firearms or restricted weapons must be treated as a real agreement, even if it is not a formal contract.

55DOffences relating to illegal manufacturing of certain arms items

  1. A person commits an offence if the person—

  2. intentionally manufactures or assembles a firearm or restricted weapon using parts that have been illegally manufactured, imported, or trafficked; or
    1. intentionally enters into a contract or an arrangement, or arrives at an understanding, to manufacture or assemble a firearm or restricted weapon using parts that have been illegally manufactured, imported, or trafficked; or
      1. does not hold a dealer’s licence, but intentionally manufactures for sale, transfer, rental, or other supply—
        1. a firearm, pistol, prohibited firearm, or restricted weapon; or
          1. a part of a firearm, pistol, prohibited firearm, or restricted weapon; or
            1. a pistol carbine conversion kit; or
            2. does not hold a dealer’s licence, but intentionally enters into a contract or an arrangement, or arrives at an understanding, to manufacture for sale, transfer, rental, or other supply—
              1. a firearm, pistol, prohibited firearm, or restricted weapon; or
                1. a part of a firearm, pistol, prohibited firearm, or restricted weapon; or
                  1. a pistol carbine conversion kit; or
                  2. intentionally fails to mark a firearm, part of a firearm, or pistol carbine conversion kit manufactured by the person in accordance with this Act or regulations made under section 74.
                    1. A person who commits an offence against subsection (1) is liable on conviction to imprisonment for a term not exceeding 10 years.

                    2. For the purposes of this section, anything that purports to be, or is intended to have the effect of, a contract, an arrangement, or an understanding must be treated as a contract, an arrangement, or an understanding (as the case may be).
