If you want to change a section 52P decision in a big way, the Commission must talk to people who are interested first. But if the change is small, they do not need to ask anyone beforehand. The Commission does not have to hold an inquiry before making changes to a decision. When the Commission makes a change, they must tell the suppliers affected by the decision about the change and where they can find it as soon as possible.

If the change is about a customised price-quality path that starts under section 53ZA(3), it can come into effect before it is officially published under the Legislation Act 2019.

52QAmendment of section 52P determination

  1. A section 52P determination may be amended in a material way only after the Commission has consulted with interested parties, but may be amended in a non-material way without prior consultation.

  2. However, the Commission is not required to conduct an inquiry before amending a determination.

  3. As soon as practicable after making an amendment, the Commission must give to each supplier to whom the determination relates notice of the amendment and where it is available.

  4. An amendment relating to a customised price-quality path that takes effect under section 53ZA(3) may come into force before it is published under the Legislation Act 2019.
