When the Commerce Commission makes decisions, it must think about the Government's economic policies. The Minister will send these policies to the Commission in writing from time to time. You can find these policies in the Gazette and they will also be shown to Parliament.

The Minister must publish these policies as soon as possible after sending them to the Commission. This helps everyone know what the Government's economic policies are. The policies sent to the Commission are not the same as directions under Part 3 of the Crown Entities Act 2004.

26Commission to have regard to economic policies of Government

  1. In the exercise of its powers under this Act, the Commission shall have regard to the economic policies of the Government as transmitted in writing from time to time to the Commission by the Minister.

  2. The Minister shall cause every statement of economic policy transmitted to the Commission under subsection (1) to be published in the Gazette and laid before Parliament as soon as practicable after so transmitting it.

  3. For the avoidance of doubt, a statement of economic policy transmitted to the Commission under this section is not a direction for the purposes of Part 3 of the Crown Entities Act 2004.
