When the Commission wants to make a new service quality code, it must tell the public how it will do this. You will see a public notice about the process the Commission will follow to make the code. The Commission will also talk to the Water Services Authority - Taumata Arowai and other people who are interested in this.

The Commission will then give public notice of a draft code, which is like a trial version of the code. If you want to have a say in what the code should look like, you can make a submission to the Commission within 30 working days of the public notice.

57ZIProcess for making or amending Commission service quality code

  1. To make a Commission service quality code, the Commission must—

  2. give public notice of the process that it will follow to make the code; and
    1. consult the Water Services Authority—Taumata Arowai and other interested persons; and
      1. give public notice of a draft code.
        1. A person is entitled to make a submission to the Commission not later than 30 working days after the date on which the Commission gives public notice of the draft code.

        2. The Commission must—

        3. take reasonable steps to identify classes of vulnerable consumers; and
          1. consider the impact of the provision of services on vulnerable consumers and take the interests of those persons into account when making the code.
            1. The Commission may make the code only if satisfied that the draft code meets all the requirements set out in this subpart.

            2. The Commission may amend or revoke and replace the code if the Commission considers that the code should be changed to better promote the purpose of this Part.

            3. The same procedure that applies to making a code in subsections (1) to (4) must be followed to make an amendment or a revocation and replacement, with any necessary modifications, except that subsections (1) to (4) do not apply if the Commission is satisfied that an amendment is non-material.
