When you read this part of the law, some words have special meanings. A local authority is what the Local Government Act 2002 says it is. You can find this in section 5(1) of that Act.

A stormwater service is when stormwater is collected, treated, or discharged in a town or city. It also includes services that the government says are stormwater services, but it does not include services that the government says are not stormwater services, or services related to roads and railways.

Treaty settlement obligations mean what the Local Government (Water Services) Act 2025 says they are, as stated in section 4 of that Act.

A wastewater service is when wastewater is collected, treated, or discharged from homes and businesses. It also includes services that the government says are wastewater services, but it does not include services that the government says are not wastewater services.

A water supply service is when water is taken from a source, stored, treated, and supplied to homes and businesses for drinking and other uses. It also includes services that the government says are water supply services, but it does not include services that the government says are not water supply services.

When you see the words drinking water and urban area, they mean what the Local Government (Water Services) Act 2025 says they are, as stated in section 4 of that Act.

In this part of the law, and in Schedule 7, some charges are treated as prices for water or wastewater services, as stated in section 88 of the Local Government (Water Services) Act 2025.

57AInterpretation for this subpart

  1. In this subpart and in Schedule 7, unless the context otherwise requires,—

    local authority has the meaning given in section 5(1) of the Local Government Act 2002

      stormwater service—

      1. means the collection, treatment, drainage, or discharge of stormwater in an urban area; and
        1. includes a service declared to be a stormwater service by an Order in Council made under section 57B; but
          1. does not include—
            1. a service declared not to be a stormwater service by an Order in Council made under section 57B:
              1. a service relating to a transport corridor

              Treaty settlement obligations has the meaning given in section 4 of the Local Government (Water Services) Act 2025

                wastewater service—

                1. means the collection, treatment, storage, transmission, metering, or discharge of wastewater from consumers; and
                  1. includes a service declared to be a wastewater service by an Order in Council made under section 57B; but
                    1. does not include a service declared not to be a wastewater service by an Order in Council made under section 57B

                      water supply service—

                      1. means the abstraction, storage, treatment, transmission, or metering of water for supply to consumers if any of the water supplied is intended to be used as drinking water; and
                        1. includes a service declared to be a water supply service by an Order in Council made under section 57B; but
                          1. does not include a service declared not to be a water supply service by an Order in Council made under section 57B.

                          2. In subsection (1), drinking water and urban area have the meanings given in section 4 of the Local Government (Water Services) Act 2025.

                          3. In this subpart and Schedule 7, serviceability charges under section 88 of the Local Government (Water Services) Act 2025 must be treated as prices for supplying water supply services or wastewater services, as the case may be.
