When the Commission looks into how airport services are regulated, they have to think about a few things. They must consider whether they should use a different type of regulation, in addition to making companies share information. You might wonder what these types of regulation are - they include negotiate/arbitrate regulation, default/customised price-quality regulation, and individual price-quality regulation.

The Commission also has to decide how any new regulation would apply to airport companies. As part of their inquiry, they must figure out or update the rules for how airport services are supplied, following the guidelines set out in subpart 3. They have to weigh the benefits of different types of regulation against the costs.

The Commission must update these rules as soon as possible after the inquiry starts. During the inquiry, they can consider any other matters they think are necessary. The inquiry must follow the process outlined in section 52J.

56GCommission inquiry

  1. In conducting an inquiry into the regulation of specified airport services, the Commission must consider—

  2. whether, in addition to information disclosure regulation, 1 of the following types of regulation should be imposed on the services:
    1. negotiate/arbitrate regulation:
      1. default/customised price-quality regulation:
        1. individual price-quality regulation; and
        2. if so, how that type of regulation should apply to specified airport companies.
          1. As part of the inquiry, the Commission must—

          2. determine or amend (and then apply) input methodologies for the supply of the services, in accordance with subpart 3; and
            1. when considering whether a type of regulation might be imposed, assess the benefits of imposing different types of regulation in meeting the purpose of this Part against the costs of imposing those types of regulation.
              1. The input methodologies must be determined or amended as soon as practicable after the inquiry is triggered.

              2. During an inquiry, the Commission may have regard to any other matters it considers necessary or desirable for the purpose of the inquiry.

              3. An inquiry under this section must follow the process set out in section 52J.
