43: Consideration of application

When you apply to export animals from New Zealand, the Director-General considers your application. They look at how you took care of animals you exported before, and if you have the skills to export animals safely. They also think about the type of animal, how many animals, and how old they are. They consider how the animals will travel and if they might get hurt or stressed during the trip.

The Director-General thinks about the rules in New Zealand and the country where the animals are going. They look at international standards and when the animals will leave New Zealand. They also consider any regulations made under section 183C and New Zealand's reputation as a responsible exporter of animals. You can find more information about exporting animals in section 42.

The Director-General may also think about what will happen to the animals after they arrive in the other country. They consider how the animals were treated after they arrived in the country the last time you exported animals. This helps them decide if it is safe to export animals to that country again.

43Consideration of application

  1. The Director-General must, in considering any application under section 42, have regard to such of the following matters as are relevant:

  2. the manner in which the welfare of any animals previously exported by the applicant was attended to on the journey between New Zealand and the country to which they were exported:
    1. the capability, skills, and experience of the applicant in relation to the export of animals:
      1. the species or type of animal and the number of animals proposed to be exported:
        1. the ages, and the physiological state, of the animals proposed to be exported:
          1. the mode of transport proposed and the facilities provided:
            1. the length and nature of the journey proposed:
              1. the susceptibility of the animal to harm and distress under the conditions of transport proposed:
                1. any New Zealand requirements in relation to the export of the animal:
                  1. any requirements of the country into which the animal is being exported:
                    1. any relevant international standard:
                      1. the date on which it is intended that the animal leave New Zealand:
                        1. any regulations made under section 183C relating to the export of animals:
                          1. New Zealand's reputation as a responsible exporter of animals and products made from animals:
                            1. any other matters that the Director-General considers relevant to the welfare of the animal.
                              1. The Director-General may, in considering any application under section 42, have regard to the following matters:

                              2. the post-arrival conditions for the management of the animals in the importing country:
                                1. the manner in which the welfare of any animals previously exported by the applicant was attended to during—
                                  1. the 30-day period commencing on the date of their arrival in the importing country; or
                                    1. any lesser period after their arrival that the Director-General thinks fit.
