169B: Offence of contravening disqualification order

If you break a disqualification order made under section 169(3), you commit an offence. This order is about animals and can say you cannot have a particular kind of animal or any animals at all. You can get in trouble if you do not follow this order.

If you commit this offence, you can get a prison sentence or a fine when you are convicted. As an individual, you can go to prison for up to 3 years or get a fine of up to $75,000, or both. If you are a company, you can get a fine of up to $350,000.

169BOffence of contravening disqualification order

  1. A person commits an offence if the person contravenes a disqualification order made under section 169(3) (under which provision a court can make an order relating to an animal or animals of a particular kind or description or to animals generally).

  2. A person who commits an offence against subsection (1) is liable on conviction,—

  3. in the case of an individual, to imprisonment for a term not exceeding 3 years or to a fine not exceeding $75,000 or to both:
    1. in the case of a body corporate, to a fine not exceeding $350,000.
      1. In subsection (1), order includes an order varied under section 169A.
