193: Animal ethics committees

You could also call this:

"Old animal ethics committees can keep working if they were set up before this law started"

If you have a code of ethical conduct that is covered by section 192, and you appointed an animal ethics committee before this Act started, that committee can keep working. This is even if the committee's membership does not meet the requirements of section 101. The committee can keep working for as long as your code of ethical conduct is deemed to have been approved under section 91.

For the time your code of ethical conduct is deemed approved under section 91, the rules of this Act apply to your animal ethics committee. You can think of your committee as one that was appointed under this Act, and it has the same jobs and powers as those committees. This means your committee can do the things that animal ethics committees can do under this Act.

193Animal ethics committees

  1. Where a code holder in respect of a code of ethical conduct to which section 192 applies has, before the commencement of this Act, appointed an animal ethics committee that is in existence on the commencement of this Act, that animal ethics committee, even if its membership does not comply with section 101, may, for the period for which the code of ethical conduct is deemed to have been approved under section 91, continue in existence as if it were an animal ethics committee appointed under this Act.

  2. Subject to subsection (1) and to all necessary modifications, for the period for which the code of ethical conduct is deemed to have been approved under section 91, the provisions of this Act apply in relation to every animal ethics committee to which subsection (1) applies; and every such animal ethics committee has and may exercise the functions and powers conferred on animal ethics committees by this Act.
