84A: Prohibition on use of animals in research, testing, and teaching for making cosmetic

You cannot use animals to test or make cosmetics. This means you cannot use animals to develop, make, or test a cosmetic, or to develop, make, or test an ingredient that will only be used in a cosmetic. If you do, you will commit an offence.

You might be allowed to test an ingredient on an animal if it is not just for use in a cosmetic. For example, if the ingredient has another purpose, you might be able to test it on an animal for that reason.

If someone breaks this rule, they can be prosecuted, and they do not have to have meant to break the rule for them to be guilty.

84AProhibition on use of animals in research, testing, and teaching for making cosmetic

  1. A person must not use an animal in any research, testing, or teaching that is for the purpose of—

  2. developing, making, or testing a cosmetic; or
    1. developing, making, or testing an ingredient that is intended exclusively for use in a cosmetic.
      1. Subsection (1)(b) does not apply to research, testing, or teaching in relation to an ingredient that is carried out for a purpose unrelated to the intended use of the ingredient in a cosmetic.

      2. A person commits an offence who contravenes subsection (1).

      3. In a prosecution for an offence against this section, it is not necessary for the prosecution to prove that the defendant intended to commit the offence.
