When you apply for a code of ethical conduct to be approved, the Director-General considers your application. They look at the proposed code, the evidence and information you supply as required by section 87 and section 89(1), and the results of the consultation done under section 89(3).

The Director-General can approve the proposed code and add conditions they think are necessary.

If the Director-General approves the code, they must publish a notice of the approval in the Gazette. If they refuse to approve the code, they must tell you in writing that they refuse and explain why.

91Approval of code of ethical conduct

  1. The Director-General must, in considering any application under section 87, have regard to the following matters:

  2. the contents of the proposed code of ethical conduct; and
    1. the evidence and other information and particulars supplied to the Director-General in accordance with section 89(1) and paragraphs (b) and (c) of section 89(2); and
      1. the consultation conducted under section 89(3).
        1. On approving the proposed code of ethical conduct, the Director-General may impose such conditions as he or she considers appropriate.

        2. Where the Director-General approves a proposed code of ethical conduct, the Director-General must publish a notice of the approval in the Gazette.

        3. Where the Director-General refuses to approve a proposed code of ethical conduct, the Director-General must give the applicant written notice of—

        4. the refusal; and
          1. the reasons for the refusal.
