If you are an inspector, you can apply to the District Court for an order that makes someone follow the rules of the Animal Welfare Act 1999. You can also apply for an order that makes someone follow the regulations made under this Act, or a code of ethical conduct. The District Court has rules that apply to these applications, which are made under section 228 of the District Court Act 2016, but these rules can be modified by sections 145 to 155 and by any rules made under section 156. When you make an application to the District Court, you must do it by originating application.

143Application for enforcement order

  1. An inspector may apply to the District Court for an enforcement order requiring any person to comply with the provisions of—

  2. this Act; or
    1. any regulations made under this Act; or
      1. a code of ethical conduct or conditions imposed by an animal ethics committee in giving its approval of a project.
        1. Every application to the District Court under this section must be made by originating application.

        2. Subject to modification by sections 145 to 155 and by any rules made under section 156, the District Court Rules made under section 228 of the District Court Act 2016 apply to every application to the court under this section.
