156E: Change or cancellation

The Director-General can change or cancel a compliance notice. If you ask the Director-General to change or cancel a notice, they must think about your request within 10 working days. They consider why the notice was given, how a change or cancellation would affect the reason for the notice, and any other matters they think are important.

The Director-General can decide to keep the notice the same, change it, or cancel it, and they must tell you in writing what they decide. The Director-General can also cancel a notice if they think it is no longer needed, and they must tell you in writing if they do this. If you ask to change or cancel a notice, it does not mean you do not have to follow the notice while you are waiting for a decision.

156EChange or cancellation

  1. A compliance notice may be changed or cancelled under subsection (2) or cancelled under subsection (3) by the Director-General.

  2. If the Director-General receives a written application from the person to whom the notice was issued to change or cancel the notice, the Director-General—

  3. must consider the application as soon as practicable and in any event within 10 working days after the date on which the application is received, having regard to—
    1. the purpose for which the notice was issued; and
      1. the effect of a change or cancellation on the purpose; and
        1. any other matter he or she thinks fit:
        2. may confirm, change, or cancel the notice:
          1. must give the person to whom the notice was issued written notice of the confirmation, change, or cancellation.
            1. The Director-General—

            2. may cancel the notice if he or she considers that the notice is no longer required; and
              1. must give the person to whom the notice was issued written notice of the cancellation.
                1. An application to change or cancel a compliance notice does not operate as a stay of the notice.
