You are a member of the New Zealand Conservation Authority. You hold office for a term that is not more than three years. The Minister decides how long your term will be. You can be reappointed when your term ends.

The Minister can remove you from office if you go bankrupt, cannot do your job, neglect your duties, or behave badly. You can resign from office at any time by writing to the Minister.

If you die, resign, or are removed from office, the Minister must fill the vacancy. The Minister must fill the vacancy in the same way that you were originally appointed. If you were appointed under section 6D(1), the Minister can fill the vacancy in one of two ways: in the same way that you were originally appointed, or by appointing someone from the nominations received in response to the most recent call for nominations under section 6D(2) and in accordance with section 6D(3).

You will hold office for the rest of the term that the person who left was appointed for. You will keep being a member of the Authority until someone else is appointed to take your place.

6FTerm of office of members of Authority

  1. Subject to subsection (2) to (5), every member of the Authority shall hold office for such term, not exceeding 3 years, as the Minister shall specify in the notice of appointment, and may from time to time be reappointed.

  2. Any member of the Authority may at any time be removed from office by the Minister for bankruptcy, inability to perform the functions of the office, neglect of duty, or misconduct.

  3. Any member of the Authority may at any time resign his or her office by writing addressed to the Minister.

  4. If any member of the Authority appointed under any of paragraphs (a) to (f) of section 6D(1) dies, resigns, or is removed from office, the Minister must fill the vacancy so created in the manner in which the appointment to the vacant office was originally made.

  5. If any member of the Authority appointed under paragraph (g) of section 6D(1) dies, resigns, or is removed from office, the Minister must fill the vacancy so created either—

  6. in the manner in which the appointment to the vacant office was originally made; or
    1. by appointing, in accordance with section 6D(3), a person selected from the nominations received in response to the most recent call for section nominations under section 6D(2).
      1. A person appointed to be a member of the Authority under subsection (4) or subsection (4A) holds office for the residue of the term for which the vacating member was appointed.

      2. Unless a member sooner dies, resigns, or is removed from office, every member of the Authority shall continue in office until that member's successor comes into office, notwithstanding that the term for which that member was appointed may have expired.
