You cannot take a plant into or from a conservation area unless you have permission. You can get permission with a concession under Part 3B. You can also get permission with an access arrangement under the Crown Minerals Act 1991.

You might have permission if you have a lease or licence that was granted before this law started. You can also get permission if you are the manager of a marginal strip, or if you have a Crown forestry licence under the Crown Forest Assets Act 1989. The Director-General can also give you permission under section 30(2).

If you take a plant into or from a conservation area without permission, you will commit an infringement offence. This means you will break the law and might get a fine. You must follow the rules to protect the conservation area and the plants that live there.

51QTaking plants

  1. A person must not take a plant into or from a conservation area except—

  2. with the authority of and in accordance with a concession under Part 3B; or
    1. in accordance with an access arrangement under the Crown Minerals Act 1991; or
      1. in accordance with a lease or licence granted before the commencement of this Act; or
        1. in accordance with section 24H(5) (if the person is the manager of a marginal strip) or 24H(6)(a) or (b) (if the person holds a Crown forestry licence under the Crown Forest Assets Act 1989); or
          1. in accordance with an authorisation given by the Director-General under section 30(2).
            1. A person who fails to comply with this section commits an infringement offence.
