50A: Errors of description in notices may be corrected

If you see a notice with mistakes in it, the Minister can fix those mistakes. The Minister can cancel the old notice and create a new one with the correct information, or they can issue another notice to correct the mistakes. You can find out more about how notices are published by looking at Part 3 of the Legislation Act 2019.

When the Minister fixes a notice, the new notice will take effect from the date the original notice was supposed to take effect, or from a different date stated in the new notice. The Minister has to follow the same rules for publishing the new notice as they did for the original notice. If the new notice changes or replaces an old notice, it is considered secondary legislation, which has its own publication requirements.

50AErrors of description in notices may be corrected

  1. This section applies to a notice that is secondary legislation or that is required to be published in the Gazette.

  2. The publication requirements that apply to an amending notice under this section are the same as those that applied to the original notice.

  3. Where in any notice there has been made any error of description (whether with respect to the boundaries of an area of land or otherwise), the Minister may revoke the notice and issue in its place a fresh notice with amended particulars and descriptions, or may by a further notice amend the original notice to correct any such errors.

  4. Every fresh notice or amending notice under this section shall, according to its tenor, take effect as from the date on which the original notice was intended to take effect or as from such other date as may be specified in that behalf in the fresh or amending notice.

  5. A notice under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements) if the notice amends or replaces secondary legislation.
