26ZZH: Dog control permits

The Director-General can issue a special permit for your dog. This permit lets you take your dog into areas where dogs are usually not allowed. You can get a permit for your dog if you follow the rules. The Director-General looks at the rules in the Dog Control Act 1996 when deciding.

The Director-General might not give you a permit if your dog is dangerous or not registered. They might also say no if you have done something wrong with dogs before, like not looking after them properly. This includes if you have been convicted of an offence under the Dog Control and Hydatids Act 1982, section 26ZZP or section 26ZZQ of this Act, or section 56I of the National Parks Act 1980.

When you get a permit, you must carry it with you when you are with your dog in a controlled area. The Director-General can add other conditions to the permit. The permit will say what you can do with your dog and why you got the permit.

26ZZHDog control permits

  1. Subject to section 26ZZI, the Director-General may from time to time issue in respect of any dog a dog control permit allowing the owner or any other person in charge of that dog to take that dog into any controlled dog area specified in the permit.

  2. Without limiting the generality of subsection (1), it is hereby declared that the Director-General may refuse to issue a dog control permit if the permit is sought—

  3. in relation to a dog that is classified as a dangerous dog under section 31 of the Dog Control Act 1996 or is not registered under that Act; or
    1. by a person who is—
      1. a person classified under section 21(1) of the Dog Control Act 1996 as a probationary owner; or
        1. a person disqualified under section 25 of the Dog Control Act 1996 from being the owner of any dog; or
          1. a person who has been convicted of an offence under the Dog Control and Hydatids Act 1982; or
            1. a person who has been convicted of an offence against section 26ZZP or section 26ZZQ of this Act or section 56I of the National Parks Act 1980; or
              1. a person who has been convicted of an offence against the Wildlife Act 1953, the Marine Mammals Protection Act 1978, or the Trade in Endangered Species Act 1989 or any regulations made under any of those Acts.
              2. Every dog control permit issued under subsection (1) shall be subject to—

              3. the condition that the holder carry the permit on his or her person whenever the holder is in a controlled dog area and is accompanied by the dog; and
                1. such other conditions as the Director-General thinks fit to impose.
                  1. Every dog control permit issued under subsection (1) shall state the activity and purpose for which it is issued.
