26ZS: Controlled dog areas and open dog areas

The Minister can decide which areas of land are controlled dog areas or open dog areas. You need to know that the Minister manages and administers land under several Acts, including the Foreshore and Seabed Endowment Revesting Act 1991, the Marine and Coastal Area (Takutai Moana) Act 2011, the Reserves Act 1977, the Sugar Loaf Islands Marine Protected Area Act 1991, the Waitangi Endowment Act 1932–33, the Wildlife Act 1953, and this Act. The Minister can make these decisions by giving public notice.

The Minister can change or cancel any notice they have given about controlled dog areas or open dog areas. They can also change or cancel any conditions they have imposed under section 26ZU(c), but they must follow section 26ZX when doing so. A notice given by the Minister under this section is secondary legislation, which has its own publication requirements, as explained in Part 3 of the Legislation Act 2019.

26ZSControlled dog areas and open dog areas

  1. Subject to sections 26ZT to 26ZZF, the Minister may from time to time, by notice, declare any part or parts of the land managed and administered by the Minister or Department under any of the following Acts, namely,—

  2. the Foreshore and Seabed Endowment Revesting Act 1991 so far as it is saved by section 30(2) of the Foreshore and Seabed Act 2004:
    1. the Marine and Coastal Area (Takutai Moana) Act 2011:
      1. the Reserves Act 1977:
        1. the Sugar Loaf Islands Marine Protected Area Act 1991:
          1. the Waitangi Endowment Act 1932–33:
              1. the Wildlife Act 1953:
                1. this Act,—
                  1. to be either a controlled dog area or an open dog area.

                  2. The Minister may from time to time, by notice, amend or revoke any notice under this section or, subject to section 26ZX, amend or revoke any conditions imposed under section 26ZU(c).

                  3. A notice under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
