26ZG: Application of Part

This part of the law applies to freshwater fisheries. You need to know it does not apply to people using a landing net to catch fish with a rod and line. It also does not apply to people who accidentally catch fish and put them back in the water straight away.

This law does not apply to people who are allowed to take or sell freshwater fish under the Fisheries Act 1996 or regulations made under that Act. It also does not apply to people who are allowed to take or sell freshwater fish under regulations made under section 48B of this Act.

You should be aware that some people are allowed to take or sell freshwater fish if they are registered as a fish farmer under Part 9A of the Fisheries Act 1996, or if they are allowed to do so under Treaty settlement legislation.

Part 5BFreshwater fisheries

26ZGApplication of Part

  1. Subject to subsection (2), this Part shall apply only in relation to freshwater fisheries.

  2. Nothing in this Part shall apply to—

  3. any person using a landing net to secure freshwater fish lawfully taken with a rod and line; or
    1. any person who, having unintentionally taken any freshwater fish contrary to the provisions of this Act or any regulations made under it, immediately returns the fish with as little injury as possible, to the water; or
      1. the taking, holding, possession, sale, or disposal of freshwater fish by—
        1. a person who is specifically authorised under the Fisheries Act 1996 or any regulations made under that Act; or
          1. a person who is specifically authorised under any regulations made under section 48B of this Act; or
            1. a person acting under the authority of a registration of a fish farmer under Part 9A of the Fisheries Act 1996; or
              1. a person who is specifically authorised by or under Treaty settlement legislation.
              2. To avoid doubt, subsection (2) does not limit or affect section 26ZI or section 26ZM.
