26ZR: Using hazardous substances to catch or destroy fish

"No poisoning or shocking fish allowed"

If you want to catch or destroy freshwater fish, you must not use hazardous substances, narcotic substances, or electric fishing devices in the water. You will commit an offence if you do this.

This rule does not apply to some people, such as fish and game rangers or employees of the Department, or people who have been authorised in writing by the Director-General, the Director, or the appropriate Fish and Game Council.

The term hazardous substance in this section has the same meaning as in section 2 of the Hazardous Substances and New Organisms Act 1996.

26ZRUsing hazardous substances to catch or destroy fish

  1. Every person commits an offence who, for the purpose of taking or destroying any freshwater fish, uses in any water any hazardous substance, narcotic substance, or any electric fishing device.

  2. Subsection (1) does not apply to actions taken by—

  3. a fish and game ranger or an employee or a contractor of the Department; or
    1. any person authorised in writing for the purpose by the Director-General, the Director, or the appropriate Fish and Game Council.
      1. In this section, the term hazardous substance has the same meaning as in section 2 of the Hazardous Substances and New Organisms Act 1996.
