26ZV: Matters about which Minister must be satisfied

The Minister will not make a decision about dogs on certain land unless they are satisfied that it is a good idea. You need to think about what the land is used for and if having dogs there will be okay. If the land is a conservation area, the Minister must consider the area's management plan.

They must consider if the land is a good place for these animals to live and if dogs will be a problem. The Minister looks at the plans for the land and the animals that live there, as stated in section 26ZS, to make their decision. 26ZVMatters about which Minister must be satisfied

  1. The Minister shall not publish a notice under section 26ZS in respect of any land unless the Minister is satisfied—

  2. that the declaration of that land as a controlled dog area or an open dog area is consistent with—
    1. the purposes for which the land is held; and
      1. where the land is part of a conservation area, the management objectives of the conservation area as set out in the relevant conservation management strategy or conservation management plan; and
      2. that, in any case where the land is to be declared to be an open dog area, the declaration of the land as an open dog area, with or without conditions,—
        1. will not result in any significant risk of injury to or disturbance of protected wildlife vulnerable to dogs known by the Minister to be present, or, by reason of the habitat or source of food that the land provides, to be likely to be present, on the land; and
          1. is consistent with any plans to reintroduce protected wildlife vulnerable to dogs onto the land.
