60C: Indirect applications

When you ask someone for something, and they need permission from someone else to do it, you are involved in what is called an indirect application. If the person you ask needs to get approval from someone covered by section 60A, then the rules in section 60B apply to you. This means you are treated as if you had asked the person covered by section 60A directly for the approval or permission.

If someone else makes an application to a person covered by section 60A because of your request, then section 60B applies to you. You are treated as if you had made the application to the person covered by section 60A yourself. This also applies if someone makes an application to the Minister because of your request.

60CIndirect applications

  1. Where—

  2. any person (in this section referred to as the beneficiary) applies to a person (being a person to whom section 60A does not apply) for, or otherwise requests from any such person, any action, decision, or thing; and
    1. by virtue of this Act or any other enactment, the action, decision, or thing may not be done, given, granted, issued, reached, taken, or undertaken, except—
      1. with the approval, authority, concession, concurrence, consent, licence, permission, or permit of a person to whom section 60A applies; or
        1. after any such person has made a decision, or taken or undertaken an action, of a specified kind or description; or
          1. by an Order in Council made on the recommendation of the Minister, or the Minister and 1 or more other Ministers jointly, or made under an Act administered by the Department; or
            1. with an approval, authority, concession, concurrence, consent, licence, permission, or permit given, granted, or issued by such an Order in Council; and
            2. as a consequence of the beneficiary's application or request, an application or other request is made by any person—
              1. to a person to whom section 60A applies for the approval, authority, concession, concurrence, consent, decision, licence, permission, permit, or action concerned; or
                1. to the Minister to recommend the making of the order concerned,—
                2. section 60B shall have effect as if the beneficiary had made the latter application or request directly to the person to whom section 60A applies or, as the case may be, to the Minister.
