175: Service of deportation order

If you are liable for deportation, you can be given a deportation order. This order can be given to you on or after a specific date or time mentioned in section 175A. If you want, you can ask to get the order earlier.

Only an immigration officer, someone acting for them, or a police officer can give you the deportation order. They can’t give it to just anyone.

If you’re outside New Zealand, you can only be given a deportation order if you still have a visa for New Zealand.

175Service of deportation order

  1. A deportation order may be served on a person who is liable for deportation on or after the date or time specified in section 175A.

  2. However, a deportation order may be served on an earlier date, if requested by the person liable for deportation.

  3. A deportation order may only be served by an immigration officer (or by another person on behalf of an immigration officer) or a constable.

  4. A deportation order may only be served on a person outside New Zealand if the person still holds a visa.
