343: Aiding and abetting

You commit an offence against this Act if you do any of the following things:

If an immigration officer or a refugee and protection officer asks you to produce or give up a document, or provide information as required by this Act, you refuse or fail to do so without a good reason.

If you are warned as explained in section 279, you refuse or fail to do what an immigration officer asks you to do under that section without a good reason.

You don’t stay in an immigration control area or another place you’re told to stay in, or you don’t follow an immigration officer’s instructions while you’re in these places.

You resist or deliberately get in the way of an immigration officer, refugee and protection officer, or police officer when they’re doing their job under this Act.

You refuse or fail to provide biometric information (like fingerprints) when asked under section 104, 111, or 120.

You refuse or fail to provide biometric information when a court order says you must.

Offences

344Obstruction or failing to meet requirements

  1. Every person commits an offence against this Act who,—

  2. without reasonable excuse, refuses or fails to produce or surrender any document, or to supply any information, when required to do so by an immigration officer or a refugee and protection officer in accordance with any of the provisions of this Act; or
    1. after being warned in accordance with section 279, refuses or fails without reasonable excuse to comply with any requirement of an immigration officer under that section; or
      1. fails to remain in an immigration control area or other prescribed place when required to do so, or to follow an immigration officer's instructions while in an immigration control area or other prescribed place; or
        1. resists or intentionally obstructs any immigration officer, refugee and protection officer, or constable in the exercise of the powers of that officer or constable under this Act; or
          1. refuses or fails to provide biometric information under section 104, 111, or 120; or
            1. refuses or fails to provide biometric information in accordance with a compulsion order.
