Immigration Act 2009

Compliance and information - Powers relating to deportation and turnaround

286: Powers of entry and search relating to deportation

You could also call this:

“Immigration officers can enter and search places to give deportation notices or carry out deportation orders”

You need to know about the powers that immigration officers have when it comes to deportation. They can do certain things without needing extra permission.

If an immigration officer needs to give you a notice about deportation or carry out a deportation order, they can enter and search any building or place where they think you might be. They can do this at any reasonable time during the day or night. If they need to, they can use force to get in.

The officer can go into these places if they have good reasons to believe you’re there. Once inside, they can give you the deportation notice or carry out the deportation order.

Remember, these powers are given to immigration officers by the law. They don’t need any other authority to do these things when it comes to deportation matters.
