373: Immigration status of persons born in New Zealand on or after 1 January 2006

If you were born in New Zealand on or after 1 January 2006 and you are not a New Zealand citizen, this law applies to you. From the moment you are born, you get the best immigration status that either of your parents had when you were born. The immigration status you get is decided using section 374. All the rules that apply to someone with that status will apply to you too. You keep this status until one of two things happens: you leave New Zealand, or you are given a different immigration status under this law.

373Immigration status of persons born in New Zealand on or after 1 January 2006

  1. This section applies to a person who—

  2. is born in New Zealand on or after 1 January 2006; and
    1. is not a New Zealand citizen.

      1. From birth, the person is deemed to have the most favourable immigration status of either of his or her parents at the time that he or she was born, as determined under section 374, and the provisions of this Act that apply to a person of that immigration status apply to the person accordingly until either—

      2. the person leaves New Zealand; or
        1. the person is accorded a different immigration status under, or by the operation of, this Act.
