You can be detained if you do not follow the conditions set when you were released. This can happen if an immigration officer thinks you have not followed the conditions without a good reason. You can also be detained if an immigration officer applies for an order to keep you in detention or to deport you from New Zealand. You may be arrested and detained under section 312 or section 313 for these reasons. An immigration officer can make this decision if you have not followed the conditions set under section 324F or changed under section 324G. This decision can also be made if an immigration officer applies for an order under section 324(2)‎(a) to keep you in detention. You can be detained to carry out a deportation order or to put you on a craft leaving New Zealand. This is another reason why an immigration officer can decide to detain you.

324HCircumstances in which person released on conditions may later be detained

  1. A person may be detained under section 312 or arrested and detained under section 313

  2. if an immigration officer determines that the person, without reasonable excuse, has failed to comply with any conditions imposed under section 324F or varied under section 324G; or
    1. if an immigration officer makes an application under section 324(2)(a) for an order that the person be detained under a warrant of commitment; or
      1. in order to execute a deportation order or place the person on the first available craft leaving New Zealand.
