113: Revocation of entry permission for administrative error

If an immigration officer thinks there was a mistake when giving you permission to enter New Zealand, they can take that permission away. This can happen if the officer has good reasons to believe there was an error in the paperwork or process.

If you’re still in the immigration control area where the mistake happened, the officer can cancel your entry permission at any time before you leave that area.

If you got permission to enter New Zealand while you were outside the country, the officer can cancel it before you leave the place set by the head of immigration. They can also cancel it before you leave the arrival hall at the airport or port where you arrived in New Zealand.

When an officer cancels your entry permission because of a mistake, they write it down in the immigration department’s records. The cancellation starts working right away as soon as it’s written down.

113Revocation of entry permission for administrative error

  1. An immigration officer may revoke a person's entry permission if the immigration officer believes on reasonable grounds that the entry permission was granted as a result of an administrative error.

  2. Entry permission may be revoked at any time before the person leaves the immigration control area where the error was made.

  3. If the person has been granted entry permission outside New Zealand, entry permission may be revoked at any time before—

  4. the person leaves the place designated by the chief executive under section 383 where the error was made; or
    1. the person leaves the arrival hall of the airport or port at which he or she arrived in New Zealand.
      1. A revocation under this section is made by entry on the records of the Department, and takes effect immediately.
