382: Chief executive to designate immigration control areas

The chief executive can choose certain places in New Zealand as immigration control areas. These places can be parts of airports, parts of ports, or any other place where people coming to or leaving New Zealand need to be checked.

When the chief executive chooses a place, they must tell the person in charge of that place in writing. This could be the airport or port operator, or the owner or person who controls the place.

The chief executive also needs to let everyone know about these chosen places. They do this by making a description of the area available for free. You can find this description at Department offices and at New Zealand Government offices in other countries that deal with immigration.

382Chief executive to designate immigration control areas

  1. The chief executive may designate the following places in New Zealand as immigration control areas:

  2. all or any part of the area of an airport:
    1. all or any part of the area of a port:
      1. any other place that the chief executive considers appropriate for processing people arriving in and departing from New Zealand.
        1. The chief executive must give written notice of a designation under this section to—

        2. the operator of the airport or port concerned; or
          1. the person otherwise in control of the place (being an owner, occupier, lessee, or sublessee).
            1. The chief executive must also publicly notify any designation under this section by making available a description of the designated area or place, free of charge, at—

            2. offices of the Department; and
              1. New Zealand Government offices overseas that deal with immigration matters.
