61: Grant of visa in special case

The Minister can choose to give you a visa at any time, even if you’re in New Zealand without permission. This can happen if you don’t have a deportation order or a removal order against you. The Minister doesn’t need a reason to do this - it’s completely up to them to decide.

61Grant of visa in special case

  1. The Minister may at any time, of the Minister’s own volition, grant a visa of any type to a person who—

  2. is unlawfully in New Zealand; and
    1. is not a person in respect of whom a deportation order is in force; and
      1. is not a person in respect of whom a removal order is in force.
        1. A decision to grant a visa under subsection (1) is in the Minister’s absolute discretion.
