Immigration Act 2009

Offences, penalties, and proceedings - Infringement offences

362A: What infringement notice must contain

You could also call this:

“Required information in an infringement notice”

If you get an infringement notice, it must contain specific information. This notice will be in a form decided by the government. The notice needs to tell you about the offence you’re accused of, including when and where it happened. It will also say how much the fine is and where to pay it. You’ll see the address of the Department and instructions on how to pay the fine. The notice will tell you how long you have to pay.

There will be a summary of a part of the Summary Proceedings Act. This is another law that relates to these notices. The notice will also tell you that you have the right to ask for a hearing if you want to challenge the fine. It will explain what happens if you don’t pay the fine or ask for a hearing.

The government might add other things that need to be in the notice. These would be listed in section 400 of the Immigration Act.
