461: Delegation of powers of Minister

“Minister can give their powers to others and take them back”

The Minister can give some of their powers to other people. If the Minister did this before the new Immigration Act 2009 started, those powers are still given to those people. This is called a delegation.

The Minister can take back these powers if they want to. They can do this using section 380(3) of the new Act.

When the Minister gave these powers before, it was done using section 131 of the old Act. Now, it’s treated as if it was done under section 404 of the new Act.

These old delegations still work, but they might need some small changes to fit with the new Act.

461Delegation of powers of Minister

  1. A delegation made by the Minister under section 131 of the former Act and in force immediately before the commencement of section 404 of this Act remains in force on and from the date of that commencement according to its tenor and with any necessary modifications.

  2. A delegation saved by subsection (1) may be revoked by the Minister under section 380(3) of this Act.
