469: Bonds imposed under former Act

“Rules for getting back or losing immigration bonds paid under the old law”

If you had to pay a bond under the old immigration law, you can now get it back or lose it under the new law. The new law treats your bond as if it was paid under the new rules.

When you ask for your bond back, the time you have to do this includes any time that passed before the new law started. This means you don’t get extra time just because the law changed.

469Bonds imposed under former Act

  1. On and from the commencement of section 404 of this Act, a bond imposed under the former Act may be refunded or forfeited in accordance with section 397 of this Act as if it had been imposed under this Act, and this Act applies accordingly with any necessary modifications.

  2. The period during which a person must apply for a refund of the bond under section 397(3) of this Act must be calculated including any time that has elapsed before the commencement of section 404 of this Act.
