In this part of the law, you’ll learn about some important terms related to infringement offences.

A commercial craft infringement offence is when someone breaks the rules in section 349(1) or (2)(a) of this Act. It can also be any other offence that the government decides is a commercial craft infringement offence in the rules they make under section 400.

An employment infringement offence is described in section 359A of this Act. It can also be any other offence that the government decides is an employment infringement offence in the rules they make under section 400.

An infringement fee is the amount of money you have to pay if you commit an infringement offence. For employment infringement offences under section 359A(2), the fee is set in that section. For other employment infringement offences and commercial craft infringement offences, the fee is set in the rules made under section 400.

An infringement offence can be either an employment infringement offence or a commercial craft infringement offence.

Infringement offences

359Interpretation

  1. In this Act,—

    commercial craft infringement offence means—

    1. an offence against section 349(1) or (2)(a):
      1. an offence prescribed as a commercial craft infringement offence for the purposes of this Act by regulations made under section 400

        employment infringement offence means—

        1. an offence described in section 359A:
          1. an offence prescribed as an employment infringement offence for the purposes of this Act by regulations made under section 400

            infringement fee, in relation to an infringement offence, means the infringement fee for that offence—

            1. specified in section 359A(2) (for an employment infringement offence under that section); or
              1. set in regulations made under section 400 (for other employment infringement offences); or
                1. set in regulations made under section 400 (for commercial craft infringement offences)

                  infringement offence means an employment infringement offence or a commercial craft infringement offence.
