49: Visas may be subject to conditions

Your visa might have certain conditions attached to it. These conditions depend on what type of visa you have and when you applied for it or when it was given to you.

If you have a resident visa, the conditions will be based on the rules that were in place when you applied for your visa.

For temporary visas, the conditions usually come from the rules that were in effect when your visa was granted. But if your temporary visa is a special type called ‘restricted’, then the conditions will be based on the rules from when you applied.

If you have a transit visa, the conditions will be based on the transit rules that were in place when your visa was given to you.

Sometimes, the Minister or an immigration officer can add extra conditions to your visa. These are covered in sections 50, 51, 52, 53, or 54 of this Act. There are also some conditions that are automatically added by section 55 of the Act.

Other laws might also put conditions on your visa.

The conditions on your visa might say things about your travel. They might let you come to New Zealand once, many times, or a certain number of times. They might say you can come to New Zealand for a specific time period. Or they might say that you can’t come back to New Zealand after this trip.

49Visas may be subject to conditions

  1. Every visa other than a permanent resident visa is subject to such conditions (if any) as may be,—

  2. in the case of resident visas, specified in residence instructions relating to visas of that type, being the instructions applicable at the time the application for the visa was made:
    1. in the case of temporary entry class visas other than visas subject to restricted temporary entry instructions, specified in temporary entry instructions relating to visas of that class or a type of visa within that class, being instructions applicable at the time the visa was granted:
      1. in the case of temporary entry class visas subject to restricted temporary entry instructions, specified in temporary entry instructions applicable at the time the application for the visa was made:
        1. in the case of transit visas, specified in transit instructions applicable at the time the visa was granted:
          1. imposed by the Minister or an immigration officer under section 50, 51, 52, 53, or 54:
            1. imposed by section 55:
              1. imposed by or under any other Act.
                1. The conditions of a visa relating to travel may—

                2. give permission to travel to New Zealand on a single journey, multiple journeys, or a set number of journeys; or
                  1. give permission to travel to New Zealand for or within a specified time period; or
                    1. expressly not authorise any further travel to New Zealand.
