37Administering authorities

  1. The administering authority for each multi-member Emergency Management Committee is a regional council or unitary authority that is a member of the Committee.

  2. If a Committee has both a regional council and a unitary authority as members, the regional council must be the administering authority for that Committee.

  3. Subsections (4) to (7) apply to a Committee that has—

  4. 2 or more regional councils as members; or
    1. 2 or more unitary authorities as members.
      1. Within 2 months of the date on which the Committee is established, the members must reach an agreement to appoint one of the regional councils or unitary authorities as the administering authority for that Committee.

      2. If the members fail to reach an agreement, the Minister must—

      3. appoint one of the regional councils or unitary authorities as the administering authority; or
        1. direct one, some, or all of the regional councils or unitary authorities to establish their own Committee.
          1. A regional council or unitary authority that is subject to a ministerial direction under subsection (5)(b) must comply with that direction.

          2. The members may change the administering authority for their Committee only if the Minister approves, in writing, an application from those members to change the administering authority for their Committee.
