86Preparation and approval of proposal relating to review of national emergency management plan

  1. The Minister must consider and approve a proposal developed by the Director-General.

  2. In developing the proposal, the Director-General must—

  3. identify any communities that the Director-General considers will or are likely to be a disproportionately affected community in an emergency and engage with representatives of those communities; and
    1. engage with and seek advice on Māori interests and knowledge to inform the development of the proposal; and
      1. consult persons and agencies who would have roles and responsibilities under any new or amended national emergency management plan that is being proposed.
        1. When the proposal is submitted to the Minister for consideration, the Minister must—

        2. consult other relevant Ministers about the proposal; and
          1. determine to either—
            1. approve the proposal; or
              1. refer it back to the Director-General for reconsideration, together with the Minister’s reasons for referring it back.
              2. On receiving a referral under subsection (3)(b)(ii), the Director-General must reconsider the proposal and, as soon as is reasonably practicable, submit a revised proposal to the Minister for approval.
