Declaring states of emergency: Declaring state of national emergency
109Minister may declare state of national emergency
This section applies if the Minister considers that—
- an emergency has occurred or may occur; and
- the emergency is, or is likely to be, of such extent, magnitude, or severity that the emergency management necessary or desirable in respect of it is, or is likely to be, beyond the resources of the Emergency Management Committees whose areas may be affected by the emergency.
The Minister may declare a state of national emergency that applies to—
- the whole of New Zealand; or
- 1 or more areas or districts.
The Minister must inform the House of Representatives as soon as practicable if the Minister has made a declaration under subsection (2).
