If you are a Local Controller for a unitary authority Emergency Management Committee, this section applies to you. You are appointed under section 54. The chief executive of the unitary authority can direct you to perform certain functions and duties. You must follow any directions given by the Regional Controller during a state of emergency. This direction overrides any other directions you may have. You also have to perform or exercise any functions, duties, or powers given to you by the Emergency Management Committee or by law. 58Role of Local Controllers

  1. This section applies to Local Controllers appointed under section 54 for a unitary authority Emergency Management Committee.

  2. The chief executive of the unitary authority may direct the Local Controller to—

  3. perform any of the functions and duties of, or delegated to, the Regional Controller of that Committee; and
    1. exercise the powers of Controllers in the area for which the Regional Controller is appointed, including, without limitation, the emergency powers in subpart 2 of Part 4.
      1. The Local Controller must follow any directions given by the Regional Controller during a state of emergency.

      2. Subsection (3) overrides subsection (2).

      3. The Local Controller—

      4. must also perform or exercise any functions, duties, or powers delegated to the Local Controller by the Emergency Management Committee or conferred on Local Controllers by this Act or any other enactment; and
        1. may perform any function conferred on the Local Controller by delegation under this Act.
          1. The Local Controller may authorise any suitably qualified and experienced person to perform or exercise any function, duty, or power of that Local Controller, including the power to delegate those powers, functions, and duties.
