55Provisions applying generally to appointments and removals of Regional Controllers, District Controllers, and Local Controllers

  1. Subsections (2) to (5) apply in respect of an appointment under sections 51 to 54 of a person as a Regional Controller, a District Controller, or a Local Controller, or to act in the role of a Regional Controller, a District Controller, or a Local Controller.

  2. Any person may be appointed to the position, regardless of whether they are an employee of the relevant territorial authority.

  3. An appointment—

  4. may be by name or by reference to the holder of an office; and
    1. may be made at any time, regardless of whether a state of emergency or transition period is in force.
      1. The Emergency Management Committee, or chief executive, that made the appointment may, at any time, remove from office or replace the person appointed.

      2. A person acting in the role of a Regional Controller, a District Controller, or a Local Controller may perform or exercise the functions, duties, and powers of that Controller under this Act in respect of the area, district, or region for which the Controller was appointed.
