117Extending duration of state of emergency
The Minister may declare that the duration of a state of national emergency is extended if—
- the Minister considers that—
- the criterion specified in section 109(1)(b) continues to be met; and
- the extension is required; and
- the criterion specified in section 109(1)(b) continues to be met; and
- the state of national emergency has not yet ended.
The Minister must inform the House of Representatives as soon as practicable if the Minister has made a declaration under subsection (1).
The Minister or an authorised person may declare that the duration of a state of local emergency is extended if—
- the Minister or authorised person considers that the extension is required; and
- the state of local emergency has not yet ended.
The following persons may, in declaring an extension to the duration of a state of emergency, apply that extended state of emergency to a smaller location than the location to which it previously applied:
- in the case of a state of national emergency, the Minister:
- in the case of a state of local emergency, the Minister or an authorised person.
