21Delegation of powers of Director-General

  1. The Director-General may, in writing, either generally or particularly, delegate to any public service employee (within the meaning of section 65 of the Public Service Act 2020) all or any of the functions, duties, and powers that the Director-General may perform or exercise under this Act, except this power of delegation.

  2. A delegation under this section may be made to a specified employee or to employees of a specified class, or may be made to the holder or holders for the time being of a specified office or class of offices.

  3. Section 22 applies to an exercise of the power of delegation under this section.

  4. This section—

  5. does not limit the Director-General’s power to delegate to a National Controller under section 19(2) or to a National Recovery Manager under section 20(2); and
    1. if a delegation has been made under section 19(2) or 20(2), must not be used to delegate any or all of the functions and powers of the Director-General referred to in sections 14(i) and 15(2).
