215Procedure for granting exemption
Before granting an exemption, the Director-General must be satisfied that—
- the exemption is no broader than is reasonably necessary to address the matters that gave rise to the proposed exemption; and
- the exemption is consistent with the purpose of this Act.
An exemption—
- takes effect on the date specified in the exemption (which, for a class exemption, must not be a date earlier than the date on which the class exemption is published under the Legislation Act 2019); and
- expires on the earlier of the following to occur unless it is sooner replaced or revoked:
- an expiry date specified in the exemption:
- the close of the day that is 3 years after the date on which the exemption took effect.
- an expiry date specified in the exemption:
The Director-General may—
- grant the exemption on any terms and conditions that the Director-General thinks fit; and
- amend or revoke an exemption; and
- replace an exemption before or when it expires.
