96Comments and directions from Minister regarding proposal

  1. After making any changes to update the proposal following consideration of submissions and comments received in accordance with section 95, the Committee must send the updated proposal, including a copy of any proposed new regional emergency management plan, or amendments to the plan, to the Minister for the Minister’s consideration.

  2. Within 20 working days of the Minister receiving the proposal, the Minister must provide comments and inform the Committee if the Minister is considering directing that amendments are made to the proposal.

  3. If the Minister informs the Committee that the Minister is considering making a direction, the Minister must, as soon as is reasonably practicable after informing the Committee of that possibility, make a decision about whether to make a direction and advise the Committee of—

  4. the direction regarding amendments to the proposal, along with the reasons for directing those amendments; or
    1. the decision that no direction will be made.
      1. The Minister may require amendments to the proposal only if, in the Minister’s view, the plan would otherwise fail to meet the requirements of the Act or the national emergency management plan.

      2. The Committee—

      3. must have regard to any comments made by the Minister; and
        1. may make a decision on the proposal under section 93(2) only after receiving the Minister’s advice or decision that no direction will be made under subsection (3); and
          1. must make any amendments to the proposal that the Minister directs.
