141A: Unauthorised use or possession of electronic communication device by prisoner

If you are a prisoner, you commit an offence if you use an electronic communication device without the prison manager's or chief executive's permission. You also commit an offence if you have an electronic communication device with you, knowing you are not allowed to have it. This applies whether you are inside or outside a prison.

If you commit this offence, you can be sentenced to up to 3 months in prison, a fine of up to $5,000, or both.

141AUnauthorised use or possession of electronic communication device by prisoner

  1. Every prisoner (whether inside or outside a prison) commits an offence who, except with the express authority of the prison manager or the chief executive,—

  2. uses an electronic communication device knowing that he or she is not authorised to use it; or
    1. knowingly has an electronic communication device in his or her possession.
      1. A prisoner who commits an offence against subsection (1) is liable on conviction to imprisonment for a term not exceeding 3 months, to a fine not exceeding $5,000, or to both.
