141AUnauthorised use or possession of electronic communication device by prisoner
Every prisoner (whether inside or outside a prison) commits an offence who, except with the express authority of the prison manager or the chief executive,—
- uses an electronic communication device knowing that he or she is not authorised to use it; or
- knowingly has an electronic communication device in his or her possession.
A prisoner who commits an offence against subsection (1) is liable on
conviction to imprisonment for a term not exceeding 3 months, to a fine not exceeding $5,000, or to both.
