Corrections system - Miscellaneous - Emergency management

179C: Interpretation

You could also call this:

"What special words mean in the Corrections Act 2004"

When you read sections 179C, 179D, and 179E of the Corrections Act 2004, you need to understand what some words mean. An "act or omission" refers to something described in section 179E(1)(a). An "epidemic emergency affecting a prison or prisoners" is an epidemic that happens when an epidemic notice is in force and the corrections system cannot do its job.

You also need to know what an "epidemic notice" is - it is a notice under section 5 of the Epidemic Preparedness Act 2006. A "failure" means something described in section 179E(1)(b). A "prison emergency" is an emergency that affects the safety or health of prisoners or the security of the prison, and the corrections system cannot do its job.

You should be aware that "regulations" means rules made under section 200. A "state of emergency affecting a prison or prisoners" is a state of emergency as defined in section 4 of the Civil Defence Emergency Management Act 2002, and the corrections system cannot do its job.
