179D: Notification of emergency

179DNotification of emergency

  1. The chief executive must notify the Minister within 7 days of determining the existence of—

  2. an epidemic emergency affecting a prison or prisoners; or
    1. a prison emergency; or
      1. a state of emergency affecting a prison or prisoners.
        1. A notice under subsection (1) must—

        2. be in writing and signed by the chief executive; and
          1. state the date on which it is signed; and
            1. state the nature of the emergency that exists; and
              1. specify the actions taken to date in respect of the emergency; and
                1. specify any action proposed to be taken to enable the corrections system to fulfil its purpose in section 5(1)(a).
                  1. The chief executive must notify the Minister within 7 days of determining that the emergency no longer exists.

                  2. A notice under subsection (3) must—

                  3. be in writing and signed by the chief executive; and
                    1. state the date on which it is signed; and
