179DNotification of emergency
The chief executive must notify the Minister within 7 days of determining the existence of—
- an epidemic emergency affecting a prison or prisoners; or
- a prison emergency; or
- a state of emergency affecting a prison or prisoners.
A notice under subsection (1) must—
- be in writing and signed by the chief executive; and
- state the date on which it is signed; and
- state the nature of the emergency that exists; and
- specify the actions taken to date in respect of the emergency; and
- specify any action proposed to be taken to enable the corrections system to fulfil its purpose in section 5(1)(a).
The chief executive must notify the Minister within 7 days of determining that the emergency no longer exists.
A notice under subsection (3) must—
- be in writing and signed by the chief executive; and
- state the date on which it is signed; and
- specify the actions taken in respect of the emergency.
