If you were appointed to a role under the Criminal Justice Act 1985 or the Penal Institutions Act 1954, you will keep your job. You will be deemed to have been appointed under the Corrections Act 2004, which has similar provisions to the old acts. Your terms and conditions will stay the same as they were before the new act started.

If you are one of these people, you need to know that some other sections of the act may also apply to you, such as sections 226 and 227. This section does not affect what section 21 of the Interpretation Act 1999 says. You will still be subject to the rules that apply to your role.

Appointments

228Most other appointments preserved

  1. This section applies to any person (other than a Visiting Justice who is not a Judge) who, immediately before the commencement of this section, holds office (including a position of any kind) as a consequence of any appointment, engagement, or designation under the Criminal Justice Act 1985 or the Penal Institutions Act 1954.

  2. Every person to whom this section applies is, on the commencement of this section, deemed to have been appointed to, or engaged or designated as the holder of, the office referred to in subsection (1)—

  3. under the provision of this Act that, with or without modification, corresponds to the provision in the Criminal Justice Act 1985, or the Penal Institutions Act 1954, that it replaces; and
    1. on the same terms and conditions that applied immediately before the commencement of this section.
      1. This section is subject to sections 226 and 227.

      2. This section does not limit section 21 of the Interpretation Act 1999.
